Privacy Policy

This Privacy Policy is issued pursuant to the Data Protection and Privacy Act, 2019 (Uganda), the Computer Misuse Act, 2011 (Uganda), the Electronic Transactions Act, 2011 (Uganda), and all other applicable Ugandan laws and regulations. By accessing or using the Selam Ride Technologies Platform, you consent to the terms of this Privacy Policy.

1. The Scope of This Policy

This policy applies to all Selam Ride Technologies Limited users, including Riders and Drivers (including Driver applicants), and to all Selam Ride Technologies platforms and services, including our apps, websites, features, and other services (collectively, the "Selam Ride Platform"). Your use of the Selam Ride Platform is also subject to our Terms of Service.

Selam Ride Technologies Limited is a company incorporated under the laws of Uganda and operates primarily within the Republic of Uganda. This policy is designed to comply with the Data Protection and Privacy Act, 2019 (the "DPPA"), which governs the collection, processing, storage, and sharing of personal data in Uganda.

2. The Information We Collect

When you use the Selam Ride Platform, we collect the information you provide, usage information, and information about your device. We also collect information about you from other sources like third-party services and optional programs in which you participate.

A. Information You Provide to Us

Account Registration: When you create an account, we collect your name, email address, phone number, and payment information. You may also share a profile photo, saved addresses, and preferences.

Driver Information: If you apply to be a Driver, we collect your name, email, phone number, date of birth, profile photo, physical address, Uganda National Identification Number (NIN) or valid government-issued ID, driver's licence information, vehicle information, and third-party motor vehicle insurance details. We also collect mobile money details (MTN Mobile Money or Airtel Money), bank account information, and tax identification details where applicable.

SOS Emergency Contacts: We request contact list permission to allow users and drivers to designate emergency SOS contacts, in compliance with the Electronic Transactions Act, 2011.

Ratings and Feedback: When you rate Riders or Drivers, we collect all information you provide in your feedback.

Communications: When you contact us or we contact you, we collect any information that you provide, including the contents of messages or attachments.

B. Information We Collect When You Use the Platform

Location Information: We collect precise GPS and WiFi location data. For Riders, this is from when you open the app and request a ride until it ends. For Drivers, this is during driver mode and for a limited time after exiting driver mode.

Usage Information: We collect ride information including date, time, destination, distance, route, payment, and promotional codes used, as well as your interactions with our apps and websites.

Device Information: We collect device model, IP address, browser type, operating system, carrier, radio type, preferences, application installations, device identifiers, and advertising identifiers. Drivers' devices also supply mobile sensor data (speed, direction, height, acceleration, deceleration).

Communications Between Riders and Drivers: We work with a third party to facilitate calls and messages without sharing actual phone numbers. We collect metadata and SMS contents. We may monitor or record phone calls for security purposes and will always notify you before recording.

Address Book Contacts: If you grant access to your contacts, we store names and contact information strictly for the purpose disclosed at the time of your consent.

Cookies, Analytics, and Third-Party Technologies: We collect information through cookies, tracking pixels, and analytics tools. You may modify cookie settings on your browser.

C. Information We Collect from Third Parties

Third-party services including background check providers, insurance partners, financial service providers, and marketing providers supply us with information needed for core platform operations, including background checks, payment and fraud detection, loyalty programmes, and demographic data.

3. How We Use Your Information

Pursuant to Section 16 of the Data Protection and Privacy Act, 2019 (Uganda), we use your personal information only to the extent necessary for the purposes for which it was collected, including to:

  • Provide the Selam Ride Platform and verify your identity
  • Connect you to rides and track trip progress
  • Calculate prices and process payments via MTN Mobile Money, Airtel Money, or other approved methods
  • Allow Riders and Drivers to communicate regarding their ride
  • Maintain the security and safety of the Platform and its users
  • Verify that Drivers and vehicles meet safety requirements under the Traffic and Road Safety Act (Cap. 361)
  • Investigate and resolve incidents, accidents, and insurance claims
  • Find and prevent fraud
  • Perform research, testing, and analysis to improve the Platform
  • Respond to legal proceedings and obligations under Ugandan law

4. How We Share Your Information

We do not sell your personal data. We share your personal information only in the following circumstances and in a manner consistent with the purposes for which it was collected.

Between Riders and Drivers: Upon accepting a ride, the Driver receives the Rider's pickup location, name, profile photo, and rating. The Rider receives the Driver's name, photo, rating, real-time location, and vehicle details. Actual phone numbers are never shared; communications are facilitated through a secure third-party system.

Third-Party Service Providers: We may share personal identifiers, financial information, commercial information, technical data, and location data with providers for purposes including account servicing, ride processing, customer service, payment processing, driver application processing, identity verification, fraud detection, insurance claims, marketing, and internal research.

For Legal Reasons: We may disclose your information to comply with Ugandan law (including the DPPA, Computer Misuse Act 2011, Anti-Money Laundering Act 2013), respond to court orders, enforce our Terms of Service, or cooperate with the Uganda Police Force and other law enforcement agencies.

Corporate Transactions: We may share information in relation to a restructuring, merger, acquisition, or sale of assets, subject to applicable Ugandan company and data protection laws.

Upon Your Direction: With your explicit consent, we may disclose your personal information to third parties or for other purposes notified to you at the time of collection.

5. How We Store and Protect Your Information

Selam Ride Technologies Limited retains your personal information for as long as is necessary to provide you with the Platform and comply with our legal obligations:

  • Profile information is retained for as long as you maintain an active account
  • Transactional information (rides and payments) is retained for a minimum of seven (7) years in accordance with the Income Tax Act (Cap. 340) and the Value Added Tax Act (Cap. 349)
  • Information necessary to resolve open insurance claims, legal proceedings, or regulatory investigations is retained for as long as such matters remain unresolved

We implement reasonable and appropriate technical and organisational measures to protect your personal data against unauthorised access, loss, alteration, or disclosure, as required under Section 23 of the Data Protection and Privacy Act, 2019. No security system is infallible.

6. Your Rights and Choices

Pursuant to the Data Protection and Privacy Act, 2019 (Uganda), you have the following rights:

  • Right to be Informed: You must be told when your personal data is being collected, the purpose, and how it will be used.
  • Right to Access: You may request a copy of all personal information we hold about you.
  • Right to Rectification: You may request correction of inaccurate or incomplete data.
  • Right to Erasure: You may request deletion of your personal data, subject to lawful retention obligations.
  • Right to Object: You may object to processing where it is not required by law or contract.
  • Right to Data Portability: You may receive your personal data in a structured, commonly used format.
  • Right Against Discrimination: You have the right not to be discriminated against for exercising your data rights.
  • Right to Lodge a Complaint: You may lodge a complaint with NITA-U (the Personal Data Protection Office) if you believe your data rights have been violated.

You may also opt out of marketing emails, SMS, and push notifications. You can prevent location sharing through your device settings, though this may limit certain features. To delete your account, visit our Account Deletion page.

We aim to respond to data rights requests within thirty (30) days of receiving a verified request, in line with the DPPA timelines.

7. Children's Data

The Selam Ride Platform is not directed to children under the age of eighteen (18) years. In accordance with the Children Act (Cap. 59) and the Data Protection and Privacy Act, 2019, we do not knowingly collect personal information from children under the age of 18. If you believe a child under 18 has provided us with personal data, please contact us immediately.

8. Links to Third-Party Websites

The Selam Ride Platform may contain links to third-party websites with privacy policies that differ from ours. Selam Ride Technologies Limited is not responsible for the privacy practices of third-party websites. Please review their policies before providing any personal information.

9. Cross-Border Data Transfers

Where Selam Ride Technologies Limited transfers personal data outside of Uganda, we shall ensure that such transfers comply with Section 19 of the Data Protection and Privacy Act, 2019. Personal data will only be transferred where adequate data protection safeguards are in place, or where you have given explicit consent.

10. Changes to This Privacy Policy

We may update this policy from time to time. If we make material changes, we will notify you through the Selam Ride Platform or by email or SMS. Your continued use of the Platform after the effective date of the updated policy constitutes your acceptance of its terms.
